Quesro Distance Sales Agreement
This Distance Sales Agreement ("Agreement") is entered into electronically, in accordance with Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, between a user who purchases a digital service (membership plan, token package, etc.) through the quesro.com website and the Quesro application and the service provider. A user who confirms a purchase is deemed to have accepted all provisions of this Agreement.
1- Parties
1.1. Seller / Service Provider
1.2. Buyer / User
The "Buyer" is the natural or legal person who purchases a membership plan, token package, or other paid digital service through the Quesro platform, identified by the name, email and contact information provided at registration and recorded in the order/payment record.
2- Subject of the Agreement
The subject of this Agreement is to determine the rights and obligations of the parties in accordance with Law No. 6502 and the Regulation on Distance Contracts, in connection with the sale and performance of the digital service (membership plan and/or token package) ordered electronically by the Buyer through quesro.com, whose characteristics and sale price are specified below.
3- Essential Characteristics of the Service and Sale Price
The type of service purchased (membership plan name or token package), its scope (question generation/token limit, validity period, etc.), total sale price (including VAT, if applicable) and payment method are shown to the Buyer on quesro.com at the time of order and/or communicated as an order confirmation to the Buyer's email address. This information is an integral part of the order and constitutes an annex to this Agreement.
Payment is made by credit/debit card through the secure payment infrastructure of shopier.com (for Turkish Lira payments) or of Paddle.com (for payments in other currencies, as our reseller of record for international customers); card details are entered directly on that provider's page and are not stored by Quesro. The service is credited to the Buyer's account immediately after the payment is confirmed. Prices and plan content may be updated without prior notice; an update does not affect orders completed before the date of the update.
4- Performance of the Service
The purchased service is performed electronically and immediately (or, at the latest, within a reasonable period) upon confirmation of the payment, by being credited to the Buyer's account. Because the service is digital in nature, there is no shipping/delivery process.
5- Right of Withdrawal
Under Article 15, paragraph 1, subparagraph (ğ) of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised in respect of "services performed immediately in electronic form or intangible goods delivered to the consumer immediately." By confirming an order, the Buyer acknowledges that the service is of this nature and that, once payment is made, performance begins immediately, and that accordingly no statutory right of withdrawal exists.
In line with this statutory exception, Quesro does not issue refunds for completed purchases; the amount paid is not refunded, in whole or in part, regardless of usage.
6- General Provisions
The Buyer declares that, before confirming an order, they were clearly and comprehensibly informed on quesro.com, in a manner appropriate to the electronic environment, about the essential characteristics of the service, the sale price, the payment method and the performance conditions, and that they have read and accepted this Agreement together with the Terms of Use and the Privacy Policy.
By confirming the order, the Buyer is deemed to have expressly requested and consented to the immediate commencement of performance for services with respect to which no right of withdrawal exists.
The Seller shall not be held liable for temporary technical disruptions that may occur with third-party artificial intelligence service providers or in internet infrastructure in connection with the provision of the service, unless caused by the Seller's own fault; in such cases, the service will be restored as soon as possible.
If any provision of this Agreement is deemed invalid or unenforceable, this shall not affect the validity of the remaining provisions of the Agreement.
7- Resolution of Disputes
In disputes arising from this Agreement, where the Buyer has the status of a consumer, the Consumer Arbitration Committees at the domicile of the Buyer or of the Seller are competent up to the monetary limits determined annually by the Ministry of Trade, and Consumer Courts are competent for disputes exceeding this limit.
8- Entry into Force
The Buyer's purchase of a paid service through quesro.com and completion of the payment process means that all provisions of this Agreement have been read and accepted electronically; the Agreement enters into force from that moment.
